Pursuant to 35 U.S.C. § 285, and Local Rule 54.2(b)(1), Defendant, Golden Peanut Company, LLC ("Golden Peanut") hereby files its Motion for Recovery of Attorneys' Fees and Related Non-Taxable Expenses. This action was brought on April 14, 2000. Golden Peanut was one of 105 Defendants named in Plaintiff's initial Complaint. By this Court's Order of January 5, 2001, this action was stayed pending a final non-appealable judgment in Symbol Technologies, Inc. v. Lemelson Medical, Education & Research Foundation, Limited Partnership, then pending in the U.S. District Court for the District of Nevada.

On November 16, 2005, the U.S. Court of Appeals for the Federal Circuit, held that all of the claims of the patents-in-suit are unenforceable under the doctrine of prosecution laches. Symbol Technologies, Inc. v. Lemelson Medical, Education & Research Foundation, Limited Partnership, 429 F.3d 1051, 1052 (Fed. Cir. 2005). The Federal Circuit concluded that "in this exceptional case, prejudice to the public as a whole has been shown here in the long period of time during which parties, including the plaintiffs, have invested in the technology described in the delayed patents." Id. On December 22, 2005, Plaintiff filed a motion to dismiss this case in its entirety, with prejudice, in view of the Federal Circuit's determination that all claims of the patents-in-suit are unenforceable. On February 2, 2006, Judgment was entered in favor of all Defendants, including Golden Peanut, and against Plaintiff dismissing the case in its entirety, with prejudice. Reasonable attorney's fees may be awarded to the prevailing party in "exceptional cases." 35 U.S.C. § 285 (2000). Plaintiff's unreasonable delay before the U.S. Patent and Trademark Office in filing and prosecuting the asserted claims under the patents-in-suit makes this an exceptional case. Golden Peanut is the prevailing party. Golden Peanut believes that a fair estimate of the amount of attorneys' fees that will be requested is in the range of about $90,000 and that a fair estimate of the related nontaxable expenses that will be requested is in the range of about $2,000. As set forth in Local Rule 54.2(b)(1), this Motion specifies (a) the applicable judgment and the statutory authority entitling Golden Peanut to the award; and (b) a fair estimate of the amount of attorneys' fees and related non-taxable expenses sought. Golden Peanut intends to file a Memorandum in Support of this Motion within the time set forth in Local Rule 54.2(b)(2).
