statutory authority entitling Del to an award of its reasonable attorneys' fees is 35 U.S.C. § 285. See Interstate Forging Indus. v. Federal Forge, Inc., 1999 U.S. Dist. LEXIS 8760, at *7-*8 (W.D. Mich. June 8, 1999). A good faith estimate of the amount of fees and non-taxable expenses currently sought by Del is $25,000. If the parties are unable to resolve any disputes over Del's fee claim in accordance with the consultation process specified in LRCiv 54.2(d)(1), however, Del reserves its right to seek recovery of the additional attorneys' fees and nontaxable expenses it may reasonably incur in preparing the supporting memoranda and documentation described in LRCiv 54.2(b)(2)-(3) and (c)-(d), and in otherwise prosecuting its fee request to a final determination by the Court. See In re Nucorp Energy, Inc., 764 F.2d 655, 659-60 (9th Cir. 1985) ("In statutory fee cases, federal courts, including our own, have uniformly held that time spent in establishing the entitlement to and amount of the fee is compensable.")
