No defendant has opposed Lemelson's motion to dismiss with prejudice, and some have joined or supported it. Several defendants (Glaxo, Pilgrim's Pride f/k/a WLR, Schwans, Forest, McKee, and Nabisco) requested that the Court include Rule 54(b) language in the order of dismissal, but that appears unnecessary because all claims of all parties appear ready for dismissal. Del has urged the Court to condition dismissal "upon Del's right to seek an award of its reasonable attorneys' fees pursuant to 35 U.S.C. § 285 and in accordance with Rule 54.2 of this Court's Local Rules ...." Such a condition is

unnecessary as well, because Del has the right to seek fees under the cited rules (and Lemelson can oppose it if it does).
