23 Court's Local Rules of Civil Procedure, Keystone Foods LLC 24 ("Keystone") files this Motion seeking an award of attorneys' 25 fees and related non-taxable expenses and, in support thereof, 26 avers as follows: 27
1. On or about April 4, 2000, plaintiff, Lemelson

28 Medical, Education & Research Foundation, Limited Partnership

1 ("Lemelson"), initiated this proceeding by filing a Complaint 2 alleging that defendants infringed various patents issued to 3 Jerome H. Lemelson by utilizing bar code scanners or similar 4 systems in their various operations. 5
2. On or about November 3, 2000, Keystone filed its

6 Answer, Affirmative Defenses and Counterclaim denying liability 7 to Lemelson. 8
3. As part of its Counterclaim, Keystone sought

9 entry of a declaratory judgment that Lemelson's patents were 10 invalid, unenforceable and not infringed by Keystone; this case 11 is exceptional; and Keystone is entitled to attorneys' fees, 12 costs and expenses in this action. 13
4. On or about December 22, 2005, Lemelson filed a

14 Motion to Dismiss this case in its entirety, with prejudice, as 15 a result of the Federal Circuit's determination in Symbol 16 Technologies, Inc. v. Lemelson Medical, Education & Research 17 Foundation, Limited Partnership, United States Court of Appeals 18 for the Federal Circuit, No. 04-1451, that the patents at issue 19 in this proceeding are unenforceable. 20
5. On February 1, 2006, this Court entered an Order

21 of Dismissal dismissing Lemelson's action in its entirety, with 22 prejudice. 23
6. On February 2, 2006, this Court entered a final

24 judgment dismissing this action in its entirety, including all 25 claims and Counterclaims. 26
7. Section 285 of Title 35 of United States Code

27 Annotated, 35 U.S.C.A. § 285, authorizes the Court to award 28 reasonable attorneys' fees to the prevailing party.

As a result of the Court's dismissal of

2 Lemelson's action, with prejudice, Keystone is a prevailing 3 party in this proceeding. 4
9. In pursuing its infringement claims against

5 Keystone and the other defendants, Lemelson engaged in conduct 6 that was unfair, in bad faith, inequitable, unconscionable, 7 vexatious and reckless, making this an exceptional proceeding 8 within the meaning of 35 U.S.C.A. § 285. 9
10. As a result of Lemelson's improper conduct,

10 Keystone has incurred legal fees of $93,683.00 and related non11 taxable expenses of $6,593.19. 12
11. Keystone reserves the right to seek recovery of

13 additional attorneys' fees and non-taxable expenses it may 14 reasonably incur in preparing the supporting memoranda and 15 documentation required by Local Civil Rules 54.2(b)(2)-(3) and 16 (c)-(d), and in otherwise prosecuting its fee request to a final 17 determination by the Court. 18
WHEREFORE, Keystone Foods, LLC respectfully requests

19 the issuance of an Order in its favor and against Lemelson 20 Medical, Education & Research Foundation, Limited Partnership 21 awarding Keystone attorneys' fees of $93,683.00 and expenses of 22 $6,593.19. 23 24 25 Of Counsel:
