The Court will deny the motion for the reasons stated in the Supplemental Report of U.S. Pretrial Services dated November 22, 2005. Defendant recently relocated to Dallas, Texas, without prior permission of Pretrial Services and later assured the Court that no further relocation was anticipated. Mrs. Bryan had employment and family support in Dallas. Defendant's mental health care providers are at the Veteran's Hospital in Dallas, and questions have been raised concerning his mental health. He voluntarily admitted himself to the Veteran's Hospital in Dallas, for reasons not later shown to be sufficient, rather than appear as ordered for a status hearing in this court and for a court-ordered competency meeting with a psychologist (which appointment he later made as reset by this court). The new plans to relocate to Florida were not disclosed to Pretrial Services until after they were made. Defendant is set for sentencing in less than two

months, and relocation to Florida could affect his mental health and his preparation for sentencing. In light of his previous nonappearance at a court-ordered status conference and a court-ordered competency meeting with a psychologist, he is a flight risk. IT IS THEREFORE ORDERED that Defendant Paul Bryan's Amended Motion to Modify Release Conditions re Release and Travel, filed November 21, 2005 [doc. 208], is denied. The original motion to modify [doc. 207] is denied as moot. DATED this 28th day of November, 2005.
