Discussion held. With respect to the Bank of America account, there is no dispute concerning the ownership of funds, and the writ of garnishment was properly made. Any amounts being held pursuant to that writ, the Defendant is to submit a form of judgment, which the Court will sign. Bernadette Ijams is sworn and examined. Based on the sworn testimony of the witness and documents attached to pleadings, the monies in the Bank One account are of Bernadette Ijams, not Plaintiff Janet Roth. The Court orders the writ quashed and the funds shall be released back to the account. IT IS ORDERED directing defense counsel to submit a proposed order quashing the writ of garnishment by close of business this date. Regarding the writ for US Airways, defense counsel is to advise the Court within 2 weeks how counsel wishes to proceed. At this time, the Court will not quash the writ against US Airways.
