14 Defendants respond to Plaintiffs’ motion to allow Guillermo Huerta, M.D., and
15 Carol Anderson to testify telephonically at the December 7, 2005 trial as follows:
16 1. On December 5, 2005, Plaintiffs advised Defendants that they are
17 withdrawing Dr. Huerta entirely as a witness. Therefore, Plaintiffs’ motion is moot
18 insofar as it pertains to Dr. Huerta.
19 2. Defendants do not object to Ms. Anderson testifying telephonically, if she is
20 provided with a complete copy of her deposition, and copies of all exhibits offered by
21 both sides.
