15 Defendants move the Court for an Order of Summary Disposition concerning their
16 motion for leave to file a supplemental statement of facts. On July 20, 2005, at the same
17 time they filed their reply memoranda, Defendants moved for leave to file a supplemental
18 statement of facts in connection with their motion for partial summary judgment regarding
19 ERISA issues. The proposed supplemental statement of facts was attached as Exhibit A
20 to Defendants’ motion for leave.
21 Plaintiffs have not filed any response or objection to the motion for leave. The
22 deadline for filing any such objection or response was August 8, 2005. Also, Plaintiffs
23 filed a supplemental statement of facts with their reply.
24 Because the deadline for filing a response or objection has long since passed,
25 Defendants respectfully request that the Court issue an Order summarily granting their
