On May 31, 2005, plaintiff filed a document entitled "Discovery Dispute." (Doc. 22). In this document, plaintiff asks

the Court to order defendants to produce his AIMS report. Defendant has opposed production on various grounds. (Doc. 23).

As defendant has properly pointed out, the AIMS report is protected by statute, A.R.S. ยง31-221. In addition, the relevance

of the report to this litigation is unclear and plaintiff has not followed the proper procedure. The Motion to Compel by plaintiff will be denied. If there

is some portion of the AIMS report that is relevant to this litigation, plaintiff should write to defendants' counsel and specify the portion of the report and state its relevance. If the

discovery dispute cannot be resolved, plaintiff may request a telephonic hearing.

IT IS THEREFORE ORDERED denying plaintiff's "Discovery Dispute"/Motion to Compel. (Doc. 22).
