Plaintiffs, Eric Hepker and Dana Hendrix, by and through their counsel Law
Offices of G. Redmond Michaels, RC. submit the following status report pertaining to
the above captioned litigation:
1. Defendant Robert F. Alexander has been convicted of wire fraud and
was sentenced to S years in prison pursuant to criminal proceedings in 2005-CR-00472
(Arizona District Court). _
2. Pursuant to Defendant Alexander’s plea agreement, he is required to pay
$10-15 million dollars in restitution. The United States has instituted and completed
forfeiture proceedings concerning Mr. Alexa.nder’ s property. Accordingly, any
collection will likely occur via restitution.
3. Plaintiffs informed the U.S. Attorney’s office ofthe passing ofthe fake
Rolex Watches referred to in the earlier status report. In light of the more serious
charges pending against Mr- Alexander, they declined to institute actions on this crime.

4. Upon information and belief the bankruptcy proceeding (2004-bk-
05 7 02-GBN`) is being handled in conjunction with the criminal restitution, and trustee
Lorthar Goernitz continues to work with the entire class of injured investors, the United
States Probation, Office of Restitution and U.S. Attomejfs Office is resolving the
attendant forfeiture, banlmrptcy, restitution and criminal proceedings. Plaintiffs
anticipate that a receiver or trustee will be appointed to resolve all claims against Mr.
Alexander, including Plaintiffs judgment.
5. Plaintiff has released his secured interest inthe property referenced in
the court’s judgment. Therefore, Plaintiff stands as an ordinmjr unsecured creditor.
6. PlaintiE requests that the judgment remain, however any on-proceedings
be vacated and this case be removed from the cou1t’s active calendar.
WHEREFORE, Plaintiffs, Eric Hepker and Dana Hendrix, by and through their
counsel G. Redmond Michaels, P.C. provide the following status report.
