On August 17, 2006,this court ordered counsel to "file ["on or before September 5, 2006"] a Status Report pertaining to the status of this case and specifically the status of the automatic stay in the related bankruptcy case." Doc. 12. On September 6, 2006,

plaintiffs' counsel filed such a Report advising the court that "[u]pon information and belief, the bankruptcy proceeding . . . remains ongoing[.]" Doc. 13 at 2, ¶3. That Status Report further

advises that "[a]t some point, Plaintiffs anticipate that a receiver or trustee will be appointed to resolve all claims against
