In accordance with the Court's Order dated January 15, 2007, Plaintiff DIRECTV, Inc. ("DIRECTV") provides notice to the Court of the status of this matter as applicable to Defendant Darrell Lanham. On April 3, 2004, Defendant Darrell Lanham filed a voluntary petition for relief under Chapter 13 of the United States Bankruptcy Code in the United States Bankruptcy Court, District of Arizona, Case No. 2:04-bk-05644-GBN. Since that date, further

proceedings in this matter as to Defendant Lanham have been halted in accordance with the automatic stay. See 11 U.S.C. § 362(a). Defendant Lanham's Chapter 13 plan was confirmed by the bankruptcy court on December 8, 2004. Since then, Defendant Lanham has defaulted on his Chapter 13 plan. On January 12, 2007, the Bankruptcy Trustee filed a motion to dismiss Defendant Lanham's bankruptcy case because of the default. The motion is currently pending. If Defendant Lanham's bankruptcy case is dismissed, Defendant Lanham will not receive a discharge of prepetition debts or liability (such as is present in this litigation), the bankruptcy automatic stay will be lifted, and the case before this Court will be able to proceed. Accordingly, DIRECTV requests that the present stay of proceedings as to Defendant Lanham remain in place. DATED this 28th day of February, 2007. SNELL & WILMER L.L.P.
