Defendant Officer Bingaman1 by and through counsel, hereby provides
18
notice to the Court of the unknown address or whereabouts of Plaintiff Frederick
19
Ellis. Currently due to the Court today is the parties' Proposed Joint Pretrial
20
Order in this case. However, efforts by counsel for Defendant to contact Plaintiff
21
22 1 Officer Bingaman has been incorrectly identified as "Ofticer Bingamin” in several of the previous

1 to jointly prepare the Order have failed.
2 Plaintiff, who was in custody, submitted a Notice of Change of Address to
3 the Court on November 14, 2005, indicating that he had been moved from an
4 Arizona State Prison Complex in Tucson to the ASPC—WinsIow/Coronado
5 facility located at 2100 S. Highway 87, Winslow, Arizona, 86047.
6 Correspondence sent to Plaintiff by undersigned counsel at the new
7 address in late November of 2005 received no response. Undersigned counsel
8 has since contacted the Arizona State Prison Complex in Winslow, and has
9 been informed by prison ofhcials that Plaintiff was released from custody in early
10 January 2006. Their records indicate that he returned by private bus to
11 Maricopa County at that time. Prison officials indicated to undersigned counsel
12 that they have no current address for the Plaintiff.
