The Court does not believe the interlocutory appeal stays the setting of a new trial date. Discussion held re: status of plaintiff's property and status of settlement discussion(s). Trial date discussed. IT IS ORDERED setting Jury Trial on January 23, 2007, at 9:00 a.m. Estimated trial length: 3 to 4 days. Defense counsel Masterson is to apprize this Court regarding the status of his state court trial scheduled to begin on January 4, 2007. Plaintiff's request for trial transcripts at court expense is denied. The Court advises the parties the previous pretrial order entered by this Court [doc. 203] is still applicable unless either party files a motion to add additional witnesses and/or exhibits, whereupon the Court will determine if there is good cause to allow said addition(s). A copy of the exhibit marking instructions is provided to the parties this date.
