13 NOTICE is GIVEN that Plaintiff James W. Field, Appeals to the United States Court of
14 Appeals, for the Ninth Circuit, from the final Judgment, Jury Verdict for the Defendants, filed in the
15 District Court on January 26, 2007; and including but not limited to the granting of the Defendants
16 request to use photos in his opening statement after Plaintiifs opening statement was completed; the
17 Courts reiiisal to admit portions ofthe AAC regulations exhibit #53 in both trials as requested by
18 Plaintiff} the Courts refusal to admit the Uniform Code for the Abatement of Dangerous Buildings in
19 the lst trial as requested by Plaintiii alter the Jury submitted question to the Court during their
20 deliberation which would have answered said question, and in the 2"° trial the Courts refusal to allow
21 Plaintiff to admit Exhibit # 54 ,the same code as mentioned above, until the end of Plaintiffs case in
22 chief denying him the visual effect to the jury while questioning certain County employees; Final
23 Jury Instructions in both trials, specifically the final instruction which actually decided the case
24 erroneously, hi which the Court stated that the county could not and did not compel APS to cut powe
25 to Plaintiff Property,; from the Order ofthe Counts Granting of the Defendants, APS, Rule 50(a)

1 Motion for Directed Verdict as a Matter of Law, Bled June 15, 2006 during a 4 day trial, Plaintiffhad
2 previously Noticed his Appeal on July 13, 2006 however the Appeal was Dismissed as Interlocutory
3 on October 18, 2006. Plaintiff at this time is hereby giving notice of his intent to Appeal the June 15
4 2006 Dismissal ofthe Co-Defendants APS and the Granting of dismissal as to the 42 U.S.C. § 1985
5 claim against Defendants La Paz County et. al. and Co-Defendants APS et. al. fled in 2005
6 Appellant in this matter has previously been granted Leave to Proceed in Forma Pauperis and
7 Plaintiff assures this court his Bnancial circumstances has not improved during the trial of this action,
8 in fact has gotten worse because his revolving loan has since been stopped as verbally agreed upon
9 after the Bnal Judgment was rendered. Plaintiif has been and is again Bling as a Pro Se litigate.
