DEFENDANTS' SUPPLEMENTAL JURY INSTRUCTION NO. 2 The Court has determined that as a matter of law APS, Mr. McDonald, and Mr. Wilson acted as a private entity making the decision to turn off power without notice. They were not compelled to do that by anyone from LaPaz County. It is undisputed that the decision to turn off power was not made by LaPaz County; it was made by the APS employees.
