MEMORANDUM OF POINTS AND AUTHORITIES The deadline for filing dispositive motions is August 31, 2005. Undersigned

counsel needs additional time to collect the necessary documents to submit in support of the Defendants' Motion for Summary Judgment. Undersigned counsel also needs

additional time because he has been simultaneously preparing a dispositive motion in a state court case, Nolt v. Stewart (CV2002-018684) and preparing an Answering Brief for a Ninth Circuit appeal in Mulholland v. Holliday (02-CV-105). Consequently, the

Defendants request that the Court grant a short extension of time for filing dispositive motions until September 7, 2005. Rule 6(b) of the Federal Rules of Civil Procedure permits the Court for cause shown, in its discretion, to grant an appropriate extension of time to comply with the rules or an order of the Court. The Defendants contend that the reasons set forth above

constitute good cause for the Court to exercise its discretion. The Defendants are not trying to delay the timely resolution of this matter. RESPECTFULLY SUBMITTED on this 29th day of August, 2005. TERRY GODDARD Attorney General
