IT IS ORDERED denying [561] Plaintiff's Motion for Additional Jury Instruction or Verdict Form for the reasons set forth on the record. 8:32 a.m. The jury is now present in the courtroom. The Court instructs the jury as to the law applicable in this case. 9:13 a.m. At sidebar. Court and counsel discuss legal issues re: Court's jury instructions not in writing. 9:15 a.m. Jury retires to jury room in charge of sworn bailiffs to begin deliberations. Court remains in session briefly to discuss procedure to be used for jury questions. 9:17 a.m. Recess. 9:42 a.m. Court reconvenes. Counsel Ryan Anderson and Burton Bentley appear telephonically. Two (2) jury notes are received, discussed and written responses returned to the jury. 9:50 a.m. Recess. Upon request of counsel, copies of the questions and responses are fax'd to counsel. 1:20 p.m. Court reconvenes. Counsel Ryan Anderson and Burton Bentley appear telephonically. A jury note is received, discussed and a written response returned to the jury. Counsel are advised to be present in the courtroom at 5:00 p.m. unless otherwise directed by the Court. 1:35 p.m. Recess. 2:35 p.m. Jury at recess. 2:55 p.m. Jury resumes deliberations. 4:40 p.m. Court reconvenes. Ryan W. Anderson and Alison MB Patten for plaintiff. Burton M. Bentley for defendants. A jury note from juror #8 is received and discussed. No written response will be provided to the jury at this time. 4:47 p.m. Recess.

6:00 p.m. Court reconvenes with counsel present. The jury is present. Jury to resume deliberations at 8:30 a.m., 2/22/07. The jury is excused. Juror #8 (originally #19 during voir dire examination) remains in the courtroom and the juror note previously received is discussed. The matter regarding juror #8 is taken under advisement. Juror #8 is excused for the evening. Juror #3 is now present in the courtroom and advised that he is excused from jury service and released from the admonition. 6:10 p.m. Recess.
