On September 12, 2005, the court entered an agreed order certifying a question to the Arizona Supreme Court. (Clerk's Docket No. 64.) Further, on September 21, 2005, the court entered a minute order, denying the parties' motions for summary judgment with leave to renew the same after the Arizona Supreme Court had decided the question certified for review. (Clerk's Docket No. 65.) By notice filed February 9, 2006 (Clerk's Docket No. 66), the Arizona Supreme Court declined to accept jurisdiction of the question. The court has since received and reviewed the parties' joint report (Clerk's Docket No. 68), wherein the parties request that their respective motions for summary judgment be reinstated on the court's docket and that oral argument be scheduled. The clerk of court will please reinstate the motion for partial summary judgment filed by plaintiff Village Square (Clerk's Docket No. 46) and the motion for summary judgment filed by defendant State Farm (Clerk's Docket No. 53). Oral argument on said motions will be heard at 8:30 a.m. on Wednesday, March 29, 2006, in Courtroom 602, Sandra Day O'Connor Courthouse, Phoenix, Arizona. Oral argument will be limited to 15 minutes per side.
