the parties have conferred and it is their desire that the Court novv reinstate on its calendar their Motion

for Summary Judgment. The Court has correctly pointed out in its Order concerning the case status that

the parties do desire that their respective motions for summary judgment be considered and ruled upon.

It does not appear that either party has additional facts or authority to submit; however, the

parties request oral argument at the Courts convenience.
