14 Defendant, by and through his undersigned counsel, moves this Court to extend the time
15 tor tiling his brief on the issue of this Court serving as a trier of fact. Defendant's counsel has
16 been in trial since last Friday, November 18, in the matter styled State v. LaFit1e, CR2005—
17 032999-001 before the Honorable Sherry Stephens, which was originally scheduled to last one
19 Counsel has conferred with Assistant United States Attorney Richard Mesh and Mr. Mesh
20 has no objection to a short extension. It is therefore respectfully requested that this Court extend
21 the deadline for filing Dcfendant’s Brief to and including Monday, November 28, 2005.
