Defendant Robert C. Hazlett, by and through his undersigned counsel, hereby moves this

Court for a status conference so that the Court can make an in-person inquiry of Defendant

17 regarding Defendant waiving his right to a jury trial. As this Court is aware, Assistant United
States Attomey, Richard Mesh filed a Notice informing the Court ofthe parties desire to forego a

9 second jury trial, which the parties agree would not produce evidence or witnesses different from
l
the first trial. Further, the parties have reached certain agreements regarding loss figures in the

I event of a guilty verdict. In the interest assuring the Court ofthe Defendant’s desire to pursue the

22 submission described in the Govermnent's notice, it is respectfully requested that at the Court's
23 convenience, a Status Conference be convened so that Defendant can be queried about the
waiver. l
