Defendant Robert C. Hazlett, by and through his undersigned counsel, hereby moves this Court to continue the trial which is presently scheduled to begin on October 4, 2005. U.S. Attorney Richard Mesh is aware of this Motion and does not object to continuance. In fact, the parties have agreed to waive the jury trial and have requested to submit this matter on the record. Further briefing and/or oral argument may be needed and the Court will need time to review and take the matter under advisement. Defendant requests this Court enter an order vacating the current trial date and resetting it for a date after November 3, 2005, that is convenient for the Court. Excludable delay pursuant to 18 USC §3161(h)(7), §3161(h)(8)(A) and §3161(h)(B)(ii). will occur as a result of this motion and order based thereon. .....
