15 Defendant, by and through his undersigned counsel, moves this Court to extend the time
16 for tiling Briefs on the issue of this Court serving as a trier of fact. Defendanfs counsel has been
out of state in Las Vegas, Nevada and involved in pretrial hearings in a matter styled as TO USA v.

18 Phillips, er cz/`., Case Number CV-F—04-1215-RLH-GWS. It had been anticipated that the matter
19 in the District of Nevada would not interfere with the preparation of the Brief ordered by this
20 Court, but it required counsel's participation through Thursday, November l0, 2005. As a result,
Defcndant‘s counsel needs additional time to prepare and submit the Brief required by this Court
21
in its October 28, 2005 Order.

Counsel has conferred with Assistant United States Attorney Richard Mesh and Mr. Mesh
23
has no objection to a one-week extension. It is therefore respectfully requested that this Court
24
extend the deadline for tiling the Brief to and including Tuesday, November 22, 2005.
