CR 04-00276-4-PHX-SMM ORDER

On October 21, 2005, a motion to continue sentence was filed by attorney Greg Clark on behalf of his client/defendant David Roy Honderd,. The Court having received the motion late, no order granting the motion has been entered. On October 21, 2005, the courtroom deputy informed counsel that unless an order has been entered, Mr. Clark and his client were to be present on October 24, 2005 at 9:00 a.m. Neither Mr. Clark nor his client, defendant Honderd appeared before the Court on Monday, October 24, 2005 at 9:00 a.m. as ordered by this Court and reinforced by the Court's staff. THEREFORE, IT IS ORDERED setting an order to show cause hearing for October 31, 2005 at 8:30 a.m. for attorney Greg Clark and his client/defendant David Roy Honderd, to show cause why defendant's release shall not be revoked and a warrant issued for his arrest, and why Mr. Clark shall not be held in contempt and/or sanctions imposed for failure to appear on October 24, 2005 at 9:00 a.m. for the previously scheduled sentence.

IT IS FURTHER ORDERED out of necessity, and not for the reasons stated in the motion to continue, sentencing will be held at the same time as the order to show cause hearing.
