UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA United States of America, Plaintiff, v. Suzanne Lisa Prather, Defendant. GOVERNMENT'S MOTION TO CONTINUE RESTITUTION HEARING CR-04-0276-02-PHX-SMM

The United States of America by and through its undersigned attorneys, hereby moves this Court for it's order continuing the restitution hearing set for May 22, 2006, at 9:30 a.m., to a time subsequent to July 6, 2006, for the following reasons; a) The primary defendant in the above numbered cause, Robert C. Hazlett is scheduled to be sentenced on Thursday, July 6, 2006. b) As part of the sentencing proceeding in the Hazlett matter the government will present restitution information upon which defendant Hazlett will likely have joint and several liability with defendant Prather c) The arguments concerning the amount of restitution to be awarded against defendant Hazlett are equally applicable to defendant Prather. d) The government has recently acquired updated restitution figures from the victims and needs additional time to prepare an appropriate presentation for the Court's benefit. e) It is in the interest of judicial economy to postpone the Prather hearing until after the Hazlett hearing. Attorney George Klink, who represents defendant Prather has expressed to undersigned that

he has no objections to the granting of this motion to continue. The granting or denial of this motion will not impact the defendant's speedy trial rights since she has already been sentenced and is merely awaiting an amended restitution order reflecting the most currently available amounts from the victims.
