First American Payment Processing, Inc., Mathew Robinson, and Jennifer Robinson (collectively "First American") hereby give notice that they do not oppose Plaintiff's Motion to Clarify the Stipulated Protective Order ("Motion"). Although First American does not agree with the reasoning and argument the Federal Trade Commission ("FTC") advances in support of its Motion, applicable FTC regulations require that any party to whom the FTC produces First American's records maintain the confidentiality of such records. Indeed, the Stipulated Protective Order makes plain that the records

produced pursuant to the Order may be used only in the preparation, litigation, and settlement of this proceeding and, that at the conclusion of this matter, such records must be returned to First American or destroyed. See Stipulated Protective Order, ΒΆΒΆ 5(a) and 11. Nevertheless, in light of the FTC's internal requirements and the requirements of the Stipulated Protective Order concerning the continuing confidentiality of the records previously produced to the FTC pursuant to the Order, First American does not oppose
