19 for the filing of the Joint Proposed Final Pretrial Order, Joint Statement of the Case, Joint
20 Proposed Voir Dire, Joint Proposed Jury Instructions, and Joint Proposed Verdict Form
21 from January 23, 2006 to January 25, 2006.
22 The parties are very near agreement on the terms of a settlement that would dispose
23 of this entire matter. Counsel for the parties expect to know whether this case will be
24 settled by the end of the day on January 24, 2006. In the event this case does not settle,
25 counsel for defendants is scheduled to have knee surgery on February 8, 2006 and is likely
26 to be physically unable to represent defendants at trial on or near the currently scheduled

1 trial date of February 16, 2006. Accordingly, if the case doesn’t settle, counsel for
2 defendants anticipates tiling a motion to continue the trial.
3 WHEREFORE, Best Western International, Inc. and defendants Country
4 Hospitality, Inc. and Charles J. Malkus hereby jointly move the court for an order
5 extending the January 23, 2006 deadline for the filing of the above-referenced pretrial
6 documents to January 25, 2006.
