On February 28, 2006 the parties filed a Notice of Settlement, stating that the parties have reached a settlement of the claims asserted herein and anticipated the filing a stipulation for dismissal after the settlement has been finally documented. On March 1, 2006 this Court Ordered that the Clerk of the Court shall, without

further notice, dismiss this action on April 14, 2006, with prejudice, unless prior thereto a party files a request for reinstatement on the Court's trial calendar. The specific settlement terms are still being negotiated and the parties intend on filing a notice of dismissal, once the parties have signed the settlement documents. It is expected that the documents, including the exchange of releases, will occur within the

next three weeks. Therefore, it is requested that the Court extend the dismissal date for an additional thirty days to May 12, 2006.
