On May 12, 2006 Plaintiff filed a Motion to Dismiss this action, stating that the issues had been resolved. On May 16, 2006 this Court Ordered that the within cause of action be dismissed. The Court granted said Order. Unfortunately, Plaintiff failed to note that the dismissal was to be with prejudice.

Plaintiff now hereby moves for an Errata, amending the Order of Dismissal to reflect that the matter is dismissed, with prejudice and that each party is to bear their own attorney fees, costs, and disbursements.
