North American Specialty Insurance Company ("North American") has moved to intervene in this action for the limited purpose of submitting special interrogatories or a special verdict form to the jury in order to segregate the bases for any verdict against its insured, defendant Correctional Medical Services, Inc. North American's motion to intervene is primarily based upon a January 26, 2006 Order of the United States District Court, District of Eastern Missouri, in a related declaratory judgment action, which declares that North American has no duty to defend or indemnify CMS for certain claims asserted in this lawsuit. As set forth in the motion to intervene, special interrogatories or

a special verdict form is necessary, in part, to apply the Missouri District Court's Order.
