PROPOSED RESPONSE TO THE GOVERNMENT'S REPLY IN SUPPORT OF HIS MOTION TO RECONSIDER RE: ORDER FROM CHAMBERS ANCHORAGE, ALASKA JULY 26, 2005

NOW COMES, ALBERTO ABED-SCHEBAIKAN. Calezar, Ltd., Uptongrove, Ltd., 17 Casafin, Ltd., and Hartslope Holdings, Ltd., [hereinafter, "Claimants"], and file this 18 Proposed Response to the Government's Reply in Support of His Motion to Reconsider Re: 19 Order From Chambers, Anchorage, Alaska, July 26, 2005, to correct certain incorrect factual 20 assertions contained in the Government's Reply, to correct a technically infirm declaration 21 and to convey intervening events and in support would show the Court as follows: 22 1. There have been three intervening orders in the Mexican judicial proceedings 23 concerning the Amparo for the Agusta Helicopter, Model A 109E, Serial Number 11116 and 24 Cessna Caravan, Model 208B, Serial Number 208B-0941. An Amparo, in addition to the 25 Toluca Amparo [Exhibit 5 to docket 110, Amended Response to Government's Motion for 26 Rehearing] has been granted. This Amparo prohibits the sale and transfer of the Agusta and 27 28 1

Cessna. The Twenty-Seventh Circuit Collegiate Court grants an Amparo preventing the sale,

disposition, or transfer of these aircraft. See Certified Order attached as Exhibit 1. An Official Translation is being prepared and will be provided as a supplement to this Motion upon its completion. Also the Third District Judge of Quintana Roo entered an order consistent with the Three Judge Panel and its official translation is attached as Exhibit 2. Counsel understands that this Trial Mexican Court previously declined the entry of an Amparo concerning the Second Aseguramiento. This intervening order now grants an Amparo. Thus, two Amparos are in place and in force. In addition, the judge in Toluca has ordered the immediate return of the aircraft to SIASA or threatened it's recommendation that the Public Minister of the PGR be fired. The Public Minister has agreed to comply. See telegram from Toluca Court and PGR reply attached as Exhibit 3. 2. Separate independent Mexican Counsel represent the companies SIASA, Hartslope Ltd., and Casafin, Ltd. in Mexico. The name and addresses of these lawyers are: Hartslope Ltd.:Marco Antonio Corrales Murillo, Santa Catalina 323 esq. California, Col Insrgentes San Borja, Mexico D.F.; Casafin Ltd.: Luis Manuel Perez Michaud Arruti, Santa Catalina 323 esq. California, Col Insrgentes San Borja, Mexico D.F.; SIASA (Servicios Integrales de Aviacion): Virginia Brondo Romero, Calle 22 Num.37-PB, San Pedro de los Pinos, Mexico 03800 D.F. 3. The undersigned has relied on the orders and pleadings provided by Mexican counsel, upon official court translators' translations and upon expert opinions for its representations to this Honorable Court. Upon occasion, counsel has obtained a complete translation of a document partially translated by the Government in order to provide a full presentation of facts. Counsel has been advised by above Mexican Counsel that proceedings in the Amparos have not been done ex parte. In addition, the Government's Reply [Docket #111] is not supported by court orders or expert opinions. Perhaps the incorrect information the Government's Reply contains is in reliance upon an inaccurate source. Further, no expert
