The motion to stay the interlocutory sale of defendant Lear Jet at docket 105 is DENIED on the condition that the United States of America ("USA") fulfills its obligations set forth in the order for interlocutory sale of defendant Lear Jet at docket 106. Among those obligations is its duty to "refer[] to an independent FAA Certified Aircraft and Powerplant Expert" any "disputes [regarding] the need for, extent of, or airworthiness of repairs" to defendant Lear Jet. Doc. 106, p. 2. Also, the USA must take the steps to repair the aircraft before the interlocutory sale that are outlined in the order. Id., pp. 2-5.
The motion at docket 107 for leave to file an amended response to the motion at docket 95 is GRANTED. Furthermore, the USA shall file a reply to the amended response by Monday, September 26, 2005.
