MOTION FOR LEAVE TO FILE AMENDED RESPONSE TO PLAINTIFF'S MOTION FOR RECONSIDERATION OF COURT'S ORDER [DOCKET NO. 94]

1. Counsel timely filed a response for Claimants Casafin, Ltd., Hartslope Holdings Ltd., 18 Caleazar, Ltd. and Alberto Abed Schebaikan to the Plaintiff's Motion for Reconsideration of Court's 19 Order. At the time the Agusta Helicopter, Model A109E, Serial Number 11116, Mexican 20 Registration number XA-TSR and Cessna Caravan, Model 208 B, Serial Number 208B21 0941, Mexican Registration number XA-TUA were under provisional security with a new 22 bailee. 23 2. Since the time of that filing, counsel became aware of and received an order from 24 the Third District Court for Protective Orders and Federal Civil Trials Court in the State of 25 Mexico, certified today on September 13, 2005, ordering the release of the above two 26 airships to SIASA for continued flight and service of their contracts. above described aircraft are not in the bailment of SAE. 3. Counsel therefore respectfully moves this Honorable Court for Leave to File its Amended Response to Plaintiff's Motion for Reconsideration of Court's Order to reflect the intervening order of the Third District Court for Protective Orders and Federal Civil Trials Court in the State of Mexico. The Amended Motion has appended as an amended Exhibit 2, that order from the Third District Court above. The prior Exhibit 2, translations of the Government's Exhibits E and D are no longer relevant and have been removed from the Amended Motion, as has Exhibit 6, the Declaration of Virginia Brondo because it is no longer relevant. 4. As is required by the local rules of this Honorable Court, a copy of the Proposed Amended Response to the Plaintiff's Motion to Reconsider the Court's Order and the Amended Exhibit 2 are attached as Exhibits 1 and 2 to this motion respectively. A copy of the Amended Response to the Plaintiff's Motion for Reconsideration of the Court's order has been lodged with the clerk of the court for filing upon the granting of this motion. WHEREFORE, Premises considered the above Claimants respectfully pray that this Honorable Court Grant this Motion for Leave to File their Amended Response to the Government's Motion for Reconsideration of the Court's Order which is lodged with the Clerk of this Court.
