Plaintiff, United States of America, pursuant to Fed. R. Civ. Plaintiff, United States of America, by and through its attorney, Paul K. Charlton, and his
3

assistant undersigned, hereby moves this Court to enter judgment by default of the interest of
4

Servicios Integrales de Aviacion SA de CV, (SIASA), in defendants 1 through 3, for the reason
5

that said defendants were seized pursuant to a lawful warrant of this Court and SIASA has not
6

pled, answered, or otherwise made an appearance within the prescribed time, and default has
7

been duly entered according to law upon application of plaintiff.
8

This action is governed by Rule C of the Supplemental Rules for Certain Admiralty and
9

Maritime Claims. The defendants were arrested pursuant to the lawful warrant of this Court.
10

Notice was duly given, as more fully appears from the affidavit submitted with the United States'
11

Application for Entry of Default. Rule C(6)(iii) requires that any person who files a statement
12

of interest regarding the res must serve an Answer to the complaint within 20 days of filing the
13

statement of interest. In addition, SIASA has failed to file the corporate disclosure statement
14

required by Fed. R. Civ. P. 7.1 with the statement of interest. No Answer nor other pleading has
15

been filed by or on behalf of SIASA since June 4, 2004, nearly 16 months ago.
16

The time allowed has expired and plaintiff is entitled to judgment. Rule 55(a) and (b), Federal
17

Rules of Civil Procedure.
18

This Motion for Default Judgment is based upon the file and the Declaration submitted
19

with the United States' Application for Default Judgment.
