I had my paralegal check the exhibits identified by Herbert Kerner in his email to me today.
The first exhibit that Kerner identifies was unsealed by Judge Rosenblatt's 8/18/05 Order
(Doc. #64) and the others were unsealed by Judge Martone's 10/19/05 Order (Doc #158).

It is difficult for me to respond to your phone call about documents filed as exhibits in
the district court case that you indicate were filed in the ITC and marked as
"confidential business information." You failed to identify any specific document, but
instead asked for me to send you copies of all ofthe orders entered by the district court
unsealing documents. It would have been more productive for you to identify specific
documents that you have a question about. I assume that you surely know about the
attached order entered by the court in our case, dated Nov. 21, 2005, unsealing an ITC
document (see Doc. #75). I also refer you to the orders at Doc. #58 & Doc.# 64 in our
case.
In civil action No. CV 05-00365-PHX—FJM look at Doc.#158, a copy of which is
attached. is
