motion to serve questionnaires on all class members, (Doc. 272), the Ninth Circuit issued its opinion in Dukes v. Wal Mart, Inc., 474 F.3d 1214, 1238 &1241-42 (9th Cir. 2007), rejecting Wal Mart s arguments that class certification deprived it of its ability to assert defenses and that due process required individualized hearings. Plaintiffs call this case to the Court s attention because Defendants continue to argue that they have a due process right to the requested questionnaires, (Doc. 272, p. 15), that in the absence of such discovery, they would

have a due process right to call every class member to testify regarding his or her knowledge at trial, (id., p. 7), and that Plaintiffs apparent suggestion of a two-phased approach ...would abridge Defendants due process rights by preventing Defendants from presenting their defenses...
