On October 10, 2006, the parties filed a Proposed Rule 16 Scheduling Order pursuant to this Court's October 4, 2006 Order. (Docs. # 242, 246.) Plaintiffs filed revised proposed scheduling orders on November 28, 2006, December 1, 2006, and February 14, 2007. (Docs. # 257, 258, and 275.) Defendants now submit their Revised Proposed Scheduling Order in response to Plaintiffs' revised submissions. Defendants' Revised Proposed Scheduling Order makes the following limited changes to Plaintiffs' latest revised proposed schedule (Doc. # 275): · · · · · revised paragraph F to reflect that the parties now agree; revised paragraphs H and I to clarify the circumstances and events that may impact Defendants' need to take discovery from class members; revised paragraph L to conform Defendants' former proposal to Plaintiffs' current proposal; revised paragraph N to conform Defendants' former proposal to Plaintiffs' current proposal; and revised paragraph O to address the need to adjust the current proposed scheduling order if the Court grants Defendants leave to send their proposed questionnaire to class members along with the class notice.
