Defendants Phelps Dodge Corporation, Phelps Dodge Bagdad, Inc., Phelps Dodge Chino, Inc., Phelps Dodge Morenci, Inc., Phelps Dodge Sierrita, Inc., Phelps Dodge Tyrone, Inc., and Phelps Dodge Miami, Inc. (collectively, "Phelps Dodge") move pursuant to Fed. R. Civ. P. 56 for summary judgment enforcing the settlement agreement between the parties to this dispute. This motion is supported by the separately filed Memorandum in Support of Motion for Summary Judgment and Defendants' Statement of Facts ("SOF"), which demonstrate that the parties entered into a binding agreement resolving this dispute. This motion is necessary because, after agreeing to all of the terms of a detailed fully documented settlement agreement, plaintiffs Richard G. Krauth and R.M. Wade & Co. now deny the agreement and insist on resuming litigation.
