On August 16, 2004, the Court ordered that the above case be stayed pending decisions of the U.S, Patent and Trademark Office ("PTO") in reexamination proceedings involving both of the patents in suit. The reexamination applications were filed in due course and the PTO subsequently granted the requests for reexamination. In Office Actions dated October 18, 2005, the PTO issued Notices of Intent to Issue Ex Parte Reexamination Certificates confirming the patentability of all of the claims of both patents. Accordingly, the parties jointly request a status conference to discuss the lifting of the stay, and the schedule and procedures to be followed thereafter.
