IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA
Jay Jeffers Jr., Plaintiff, vs. Officer Ortega, et al., Defendants.
) ) ) ) ) ) ) ) ) ) )
No. CV-04-0572 PHX-MHM (LOA) ORDER
This matter arises on Plaintiff's pleading entitled "Supplementing Request and Apology Notice" (docket # 148). Plaintiff apologizes for his previously filed untimely response to Defendants' motion for partial summary judgment. The Court previously granted Plaintiff leave to file the untimely response to Defendants' Motion for Partial Summary Judgment (docket # 145), and Plaintiff's apology is unnecessary. To the extent that Plaintiff seeks leave to file an untimely response to Defendants' partial motion for summary judgment, the motion is denied as moot. Plaintiff also requests that the Court order Defendants to provide the real name of inmate "Star." Plaintiff does not indicate whether he has sought this information from
Defendants pursuant to a discovery request or otherwise. The Court advises Plaintiff that he should direct this request to Defendants directly in a discovery request in accordance with Fed.R.Civ.P. 26(b) and LRCiv. 33.1, 36.1, and 37.1. Accordingly,

IT IS HEREBY ORDERED that Plaintiff's pleading entitled "Supplementing Request and Apology Notice" (docket # 148), construed as a request for leave to file an untimely response to Defendants' Motion for partial summary judgment and a motion for discovery of inmate "Star's" real name is DENIED.
