This matter comes before the Court on Plaintiff Stichting Pensioenfonds ABP's Motion For Reconsideration of this Court's Order Concerning Defendants' Motions to Dismiss re: Complaint of Plaintiff Stichting Pensioenfonds ABP, dated September 12, 2005, to the extent that the Court dismissed Plaintiff's claim under Section 20(a) of the Exchange Act against Defendant Drake Tempest. Upon consideration of the submissions of the parties and the relevant law, it is hereby ORDERED that this Court's Order of September 12, 2005, shall be amended to vacate the dismissal of Plaintiff's claim under Section 20(a) of the Exchange Act against Defendant Drake Tempest.
