WILLIAM SABLAN'S WAIVER OF APPEARANCE AND REQUEST FOR ORDER The above-named defendant, by Patrick J. Burke, court-appointed cocounsel, hereby waives the appearance of his client, William Sablan, at the Hearing set for December 22, 2006. The defendant moves this Honorable Court to issue the appropriate Order so William Sablan is not transported from Florence, Colorado to Denver, Colorado for the aforementioned Hearing. As grounds, therefore, the defendant states as follows: 1) Attorney Burke has discussed with the defendant his presence at this Hearing and the defendant was clear in his waiver of his right to attend this Hearing and others like it. The defendant has made it clear to the undersigned that he does not want to be transported from the ADX to Denver for Hearings such as the Hearing scheduled for December 22, 2006. 2) The defendant William Sablan understands that the Court would permit him to be present for all Hearings. However, the defendant William Sablan has

explained to his defense team that he does not wish to attend Hearings such as this, even though he is aware that he has the legal right to be present. 3) The defendant agrees to rely on his lawyers to tell him what happened at the Hearing. WHEREFORE, the defendant, through counsel, respectfully waives his appearance at the Hearing on December 22, 2006 and respectfully requests this Honorable Court to issue the appropriate Order so that William Sablan is not transported from Florence, Colorado to Denver, Colorado for said Hearing.
