In the United States Court of Federal Claims
No. 05-410C (Filed: January 22, 2007) ****************************************** MARIO R. LOPEZ-VELAZQUEZ, Plaintiff, v. THE UNITED STATES, Defendant. ****************************************** ORDER Pursuant to the Court's Order of December 18, 2006, the parties were to file a joint status report regarding the proceedings before the Air Force Board for the Correction of Military Records ("AFBCMR" or "Board") on or before January 5, 2007. On January 10, 2007, 5 days after it was due, the parties submitted the JSR in addition to an after-the-fact joint motion to enlarge the time in which to file the JSR. In the JSR, the parties informed the Court that Plaintiff received a redacted copy of the ethics report from the Judge Advocate General on December 12, 2006, and that his response to the Board was due on or before January 12, 2007. Plaintiff intended, however, to file a motion with the AFBCMR to request an enlargement of time in which to file his comments. The Court nevertheless GRANTS the late-filed motion to enlarge the time in which to file the JSR. Plaintiff is ORDERED to file a status report on or before February 2, 2007, which provides the Court, inter alia, with the following: 1. The date on which the AFBCMR received Plaintiff's comments regarding the ethics report, or If Plaintiff has yet to submit his comments to the Board, the date on which the AFBCMR will receive Plaintiff's comments, and a detailed explanation of the reasons for the delay in submitting them. s/ Edward J.
