JOINT STATUS REPORT Pursuant to this Court's order dated October 11, 2006, the parties respectfully submit the following Joint Status Report regarding the status of proceedings before the Air Force Board for Correction of Military Records ("AFBCMR" or "board"). In the Court's order, the Court directed the parties to inform the Court whether the Judge Advocate General has released the ethics report to plaintiff's current counsel. The Judge Advocate General has not yet determined whether to release the report. We anticipate that the Office of Administrative Law will provide a recommendation to the Judge Advocate General on the release of the report by November 3, 2006. The Office of Administrative Law's recommendation continues to be delayed by short staffing at the Office of Professional Responsibility, which will also provide input to the recommendation. In addition, all of the attorneys involved in the decision will be out of the office from October 23, 2006 to October 27, 2006 for a JAG conference.
