In the United States Court of Federal Claims
No. 05-776 C (Filed: August 11, 2008) ************************************* AG-INNOVATIONS, INC., LARRY * FAILLACE, LINDA FAILLACE, * HOUGHTON FREEMAN, DOREEN * FREEMAN, SKUNK HOLLOW * FARM, INC., & FREEMAN FAMILY LLC,* * Plaintiffs, * * v. * * THE UNITED STATES, * * Defendant. * ************************************* ORDER On August 8, 2008, the parties filed a Joint Status Report. Defendant notes that it requires substantial time to understand the significance of several highly technical scientific issues raised during discovery. Plaintiffs indicate that they intend to file pre-trial motions, including a motion for summary judgment and a Daubert motion to exclude certain tests relied upon by defendant. The parties propose that plaintiffs file their dispositive and related motions on or before November 14, 2008, and that defendant respond and file its dispositive and related motions by December 12, 2008. The court adopts the parties' proposed briefing schedule. Accordingly, plaintiffs shall file their dispositive and related motions by no later than Friday, November 14, 2008, and defendant shall file its response, as well as its dispositive and related motions, by no later than Friday, December 12, 2008. In the event that the parties require additional time, they should file the appropriate motion. IT IS SO ORDERED.
