JOINT MOTION TO DISMISS COUNT II AND TO LIMIT DISCOVERY Plaintiffs, Ag-Innovations, Inc., Larry Faillace, Linda Faillace, Houghton Freeman, Doreen Freeman, Skunk Hollow Farms, Inc., & Freeman Family LLC, and the United States respectfully request that the Court enter an order dismissing with prejudice plaintiffs' claims contained in Count II of the Amended Complaint, filed on January 25, 2008, and stating that the discovery period in this case will not be extended beyond its current due date of February 29, 2008, consistent with the parties' stipulation which is attached to this motion.
