JOINT STATUS REPORT Pursuant to the Court's order dated September 12, 2007, the parties respectfully submit this joint status report. The parties are continuing to discuss settlement in this consolidated case, and most recently discussed settlement on Tuesday, October 30, 2007. The parties are making progress

towards settlement, and intend to continue their settlement discussions. Undersigned counsel for defendant, however, will be

unable to participate in settlement discussions again until the end of November 2007, due to preparation for and participation in trial in Spectrum Sciences and Software, Inc. v. United States, No. 04-1366 (Fed. Cl.). That trial is scheduled to take place Undersigned counsel for defendant
