The Clerk of the Court notified chambers that defendant's United States' Response to Plaintiffs' Motion to strike, filed on October 15, 2007 (Response), does not comply with the Rules of the United States Court of Federal Claims (RCFC). Defendant's Response does not comply with RCFC 5.2(a)(1)(G) because "if an appendix is used and is not incorporated into the same volume as the brief, there shall be, at the beginning of the appendix, a table of contents or index listing the various items in the appendix." RCFC 5.2(a)(1)(G). The court will accept defendant's Response as it has been electronically filed, but the parties shall endeavor to make future filings in compliance with RCFC. Further, defendant has not supplied the court with a courtesy copy of its Response. Because the Response, including its eleven attachments, exceeds fifty pages, defendant shall, in accordance with United States Court of Federal Claims General Order No. 42A, Part I, ΒΆ 5, provide to chambers in paper form a courtesy copy of the document.
