Defendant/Petitioner is not eligible for sealing relief because s/he was placed on supervision for or convicted of one or more of the following: a violation of 625 ILCS 11-501, et. seq. or a similar provision of a local ordinance; a misdemeanor violation of Article 11 of the Criminal Code of 1961 or a similar provision of a local ordinance; a misdemeanor violation of 720 ILCS 5/12-15, 720 ILCS 5/12-30 or 720 ILCS 5/26-5 or a similar provision of a local ordinance; a misdemeanor violation of a crime of violence under 740 ILCS 45/2 or a similar provision of a local ordinance; a Class A misdemeanor violation of the Humane Care for Animals Act (510 ILCS 70/1); or any offense or attempted offense that would be subject to registration under the Sex Offender Registration Act (730 ILCS 150/1). Defendant/Petitioner is not eligible for arrest record sealing relief because s/he was subsequently convicted of a misdemeanor or felony or was placed on supervision for a misdemeanor or felony within THREE (3) years after the acquittal or release or reversal of conviction, or completion of the terms and conditions of the supervision. Defendant/Petitioner is not eligible for conviction sealing relief because s/he was subsequently convicted of a misdemeanor or felony or was placed on supervision for a misdemeanor or felony within FOUR (4) years after the acquittal or release or reversal of conviction, or completion of the terms and conditions of the supervision. The Petition is to seal a class 4 felony. The Defendant/Petitioner had prior felony records sealed. The Defendant/Petitioner failed to attach the required drug test. The Defendant/Petitioner's drug test showed the presence of an illegal substance. The People's interest in maintaining the records outweighs the Defendant/Petitioner's interest in having the records sealed. The Defendant/Petitioner's Petition was filed in an untimely manner.
